This manual uses professional negligence as a vehicle for examining the practical application of the rules and conventions of todays civil justice system in the preparation and conduct of litigation. Particular emphasis is placed upon clinical negligence and solicitors negligence actions. The manual is divided into five parts. The first covers the substantive law including a chapter which considers the impact of the Human Rights Act 1998. The second part, the conduct and management of proceedings, builds upon the readers knowledge of the civil procedure rules and considers the philosophy behind the rules and practice directions as well as paying particular attention to the pre-action protocols and the role of the case management conference. The third part is designed to develop the readers drafting skills to an advanced and applied level in professional negligence cases. Each stage of drafting a Particulars of Claim and a defence is considered in detail and illustrated with practitioners drafts.
